Terms of Service

1. Agreement

These Terms govern your access to and use of LumenGrow (the "Service"), operated by DevSimplex ("we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. What the Service does

LumenGrow helps you detect buying signals, enrich and score prospects, and run outbound campaigns. Sending runs through your own connected mailboxes and accounts (via SMTP or OAuth), on your own sending reputation. We provide software; we are not an email service provider and do not send from shared infrastructure on your behalf.

3. Your accounts and your responsibility

You connect and control the mailboxes, domains, and third-party accounts used with the Service. You represent and warrant that you have the authority and all necessary rights and consents to connect and use those accounts, and to contact the recipients you target. You are solely responsible for your outbound activity and its content.

4. Acceptable use and legal compliance

You agree that you will not use the Service to:

• send messages that violate applicable law, including CAN-SPAM, CASL, GDPR, ePrivacy, and other anti-spam, marketing, and data-protection laws;
• contact people without a lawful basis or required consent, or without honoring opt-outs and unsubscribe requests;
• send unsolicited bulk messages in violation of law, or content that is deceptive, fraudulent, harassing, or unlawful;
• violate the terms of service of any connected provider (email, social, or otherwise), or access data you are not authorized to access;
• infringe intellectual-property or privacy rights, or scrape or process data in violation of law or a site's terms.

You are responsible for maintaining suppression lists, honoring opt-outs, and configuring proper email authentication (SPF, DKIM, DMARC) for your domains. We may suspend or terminate accounts that violate this section.

5. Plans, billing, and trials

Paid plans are billed in advance on a recurring basis through our payment processor (Stripe). Where a free trial is offered, you will be charged when the trial ends unless you cancel before then. Fees are non-refundable except where required by law. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period. We may change pricing on notice for future billing periods.

6. Data

Our handling of personal data is described in our Privacy Policy. For data about your prospects and contacts that you upload or generate, you are the data controller and we act as your processor, processing it on your instructions to provide the Service.

7. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. We do not warrant deliverability, results, or uninterrupted operation. To the maximum extent permitted by law, DevSimplex will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim will not exceed the amounts you paid to us in the twelve months before the claim.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or to comply with law. Sections that by their nature should survive termination will survive.

9. Changes and contact
